The company claims Huffman uploaded confidential documents, including a brand planning file and team goals, to his personal ChatGPT account just weeks before resigning to join DraftKings.

PrizePicks alleges that Huffman’s actions amount to trade secrets theft, as the documents contained sensitive data on market research, user demographics, and growth strategies. The company’s policies strictly forbid sharing such information on public AI platforms. The lawsuit also states that Huffman deleted data from company devices before leaving, which PrizePicks sees as an effort to hide his actions
The complaint further claims Huffman violated several terms of his employment agreement:
- Non-compete clause: Huffman was prohibited from joining a competitor for one year.
- Confidentiality: He was required to return all company property and not disclose confidential information.
- Fiduciary duty: Huffman allegedly failed to inform PrizePicks about his new job and negotiations with DraftKings

In Washington, non-compete agreements are enforceable if they meet certain conditions, such as being reasonable in scope and duration, and if the employee earns over $100,000 per year.
